Please read these terms carefully before using the AreYouFit platform. By accessing our service, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using AreYouFit, a product owned by Dinonex technologies private limited (the 'Service'), you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.
2. Description of Service
AreYouFit is a Software-as-a-Service (SaaS) platform that provides gym management tools including workout planning, diet tracking, client management, biometric access control, POS billing, and analytics. The platform is available via mobile application.
3. User Accounts
- Users must be 16 years or older to create an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate and complete registration information.
- You are responsible for all activities that occur under your account.
- Notify us immediately of any unauthorized account use at info@dinonex.com.
4. Subscription and Payments
- Gym membership plans are set by individual gym owners through the platform.
- Payments are processed by Razorpay, a licensed payment gateway in India.
- Prices are as displayed at the time of purchase and are inclusive of applicable GST.
- AreYouFit reserves the right to change platform pricing with 30 days' notice.
- Gym owners are responsible for the accuracy of pricing they set for their clients.
- Subscription auto-renewal can be cancelled from your profile settings before the renewal date.
5. Prohibited Uses
- Violate any applicable Indian or international law or regulation.
- Impersonate any person or entity.
- Reverse engineer, decompile, or attempt to extract source code.
- Use the platform for unauthorized data scraping or harvesting.
- Upload malicious code, viruses, or harmful content.
- Interfere with the security or integrity of the platform.
- Use the Service for any commercial purpose not expressly permitted.
6. Intellectual Property
All content, design, logos, code, and features of AreYouFit are the exclusive property of AreYouFit and its licensors. You may not copy, modify, distribute, or create derivative works without explicit written permission.
7. User Content
You retain ownership of content you upload (workout data, photos, etc.). By uploading, you grant AreYouFit a license to store and display this content within the platform solely to provide the Service.
8. Limitation of Liability
AreYouFit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.
9. Termination
We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice. Upon termination, your access to the Service will cease immediately. You may request account deletion at any time.
10. Indemnification
You agree to indemnify and hold harmless AreYouFit, its officers, directors, and employees from any claims arising from your use of the Service or violation of these Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in [Your City], India.
